1.Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User" or "you") and PockyPass ("we", "us", or "our") governing your access to and utilization of the PockyPass website, browser extensions (Chrome, Microsoft Edge, Brave, Mozilla Firefox), mobile applications (Android, iOS), and desktop applications (macOS, Windows).
By downloading, installing, accessing, or using any part of PockyPass, you explicitly acknowledge that you have read, understood, and agreed to be legally bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must immediately refrain from installing, accessing, or using PockyPass.
2.Zero-Knowledge Architecture & Sole User Responsibility
PockyPass operates strictly as an offline-first, client-side Zero-Knowledge security application:
Sole Custody of Credentials: You bear sole and exclusive responsibility for generating, memorizing, and safeguarding your Master Password and your Emergency Recovery Key.
Absence of Architectural Recovery Backdoors: PockyPass does not store, transmit, or replicate your Master Password or Recovery Key on any remote server. Consequently, if you lose or forget both your Master Password and Emergency Recovery Key, PockyPass developers have no technical or legal means to recover, decrypt, or reset your vault. You accept and assume total risk for vault irrevocability resulting from forgotten or misplaced credentials.
3.Subscriptions & In-App Purchases
PockyPass offers a free starter tier as well as optional paid subscription plans (e.g. Monthly, Annual, or Lifetime tiers) that provide access to premium functionality.
Platform-Managed Billing: All in-app purchases, transactions, billing cycles, and payment collections are managed and processed exclusively by Apple Inc. (via the Apple App Store) or Google LLC (via the Google Play Store). PockyPass does not directly collect, process, or store credit card details or bank credentials.
Automatic Renewal: Paid subscriptions automatically renew for successive billing periods unless cancelled by the user at least twenty-four (24) hours before the conclusion of the current billing cycle.
4.Subscription Cancellation & Refund Policy
Because billing is conducted strictly through third-party platform stores, the following procedures apply:
How to Cancel a Subscription: You can cancel your subscription at any time directly through your platform account settings:
- iOS & macOS: Open your device Settings > tap your Apple ID > tap Subscriptions > select PockyPass > Cancel Subscription.
- Android: Open Google Play Store > tap your Profile Icon > Payments & subscriptions > Subscriptions > select PockyPass > Cancel Subscription.
Refund Requests: All refund evaluations and disbursements are governed exclusively by the terms and policies of the store where the purchase originated (Apple App Store or Google Play Store). PockyPass developers do not have direct merchant access to issue refunds, alter billing amounts, or process reverse charges. Users seeking refunds must submit their requests directly to Apple or Google.
5.Third-Party Cloud Storage (Google Drive & OneDrive)
PockyPass synchronizes encrypted vault files directly with your personal Google Drive or Microsoft OneDrive account. You acknowledge that your relationship with these cloud storage providers is governed exclusively by Google's Terms of Service and Microsoft's Services Agreement. PockyPass exercises zero control over, and disclaims all liability for, third-party cloud outages, rate limits, account suspensions, API modifications, or server failures executed by Google or Microsoft.
6.Intellectual Property & Limited License
PockyPass, including its brand, trade dress, user interface, icons, source code, and documentation, is the exclusive proprietary property of PockyPass. Subject to your compliance with these Terms, you are granted a non-exclusive, non-transferable, revocable license to use the software. You agree not to decompile, reverse-engineer, modify, or unlawfully redistribute PockyPass applications.
7.Disclaimer of Warranties ("As Is")
PockyPass IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT PockyPass WILL BE UNINTERRUPTED, BUG-FREE, OR FREE OF ADVERSARIAL ATTACKS.
8.Strict Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PockyPass, ITS CREATORS, DEVELOPERS, AFFILIATES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF REVENUES, LOSS OF DATA, LOSS OF CREDENTIALS, BUSINESS INTERRUPTION, OR REPUTATIONAL DAMAGE.
Specific Exclusions of Liability: Under no circumstances shall PockyPass be held liable for:
- Any permanent or temporary loss of vault access resulting from forgotten, misplaced, compromised, or stolen Master Passwords or Emergency Recovery Keys;
- Any data corruption, synchronization delays, or data loss caused by service disruptions, downtime, or account closures on Google Drive or Microsoft OneDrive;
- Device-level compromises, keylogger intrusions, malicious browser extensions, or physical theft of your client devices;
- Failures in biometric authentication mechanisms managed by device operating systems.
In all circumstances, the total cumulative aggregate liability of PockyPass for any and all claims arising out of or related to these Terms or your use of PockyPass shall be strictly limited to the actual amount paid by you to PockyPass during the twelve (12) months preceding the claim, or fifty United States Dollars ($50.00 USD), whichever is lower.
9.Indemnification
You agree to defend, indemnify, and hold harmless PockyPass, its developers, contractors, and affiliates from and against any claims, liabilities, damages, judgments, losses, and expenses (including reasonable legal fees) arising out of your misuse of the application or violation of these Terms.
10.Governing Law & Severability
These Terms shall be governed by and construed in accordance with standard commercial and intellectual property principles. If any provision of these Terms is deemed unlawful, void, or unenforceable, that provision shall be severed without affecting the validity of the remaining provisions.
